2009 Amendments to OMVH Rules of Procedure--Effective April 30, 2009

The OMVH Rules of Procedure have been amended effective April 30, 2009. Under these amendments, Rule 11 has been amended to provide that the only discovery permitted in OMVH cases is by subpoena. Other substantive amendments have been made to Rules 9, 10, 12, 15, and 17. Click here for a copy of the amended Rules.

The Office of Motor Vehicle Hearings (OMVH) was created in 2005 and is an office within the South Carolina Administrative Law Court. There are five Hearing Officers, one of whom will be assigned to hear your case. The hearing officers conduct hearings in accordance with Chapter 23 of Title 1, the Administrative Procedures Act, and the rules of procedure for the Administrative Law Court.

The OMVH provides a neutral forum for fair, prompt and objective hearings for persons affected by an action or proposed action of the South Carolina Department of Motor Vehicles, ensuring due process and respecting the dignity of all.

The Chief Judge of the Administrative Law Court is responsible for the administration of the division, the assignment of cases, and the administrative duties and responsibilities of the hearings officers and staff.

There is a $150 filing fee for all cases filed at the OMVH.
